Modern Nuclear, Inc. Continues Advancing Mobile Cardiac PET/CT Imaging Following DOJ Resolution

Modern Nuclear, Inc. is pleased to announce that it has reached a resolution with the United States
Department of Justice (DOJ). Following similar investigations into the industry, the DOJ reviewed the
operations of Modern Nuclear, Inc., one of the earliest providers of mobile Rubidium-82 (Rb-82) PET
imaging services.

In 2009, Modern Nuclear, Inc. pioneered one of the first mobile Rb-82 PET trailers, offering
physicians and patients access to advanced diagnostic imaging with greater accuracy than traditional
SPECT studies. This technology enabled shorter appointment times, improved image clarity, and
reduced radiation exposure for patients. Since its inception, Modern Nuclear, Inc. has remained
committed to ethical business practices and to continuously strengthening its compliance programs.
Over the years, the company has further enhanced its services by upgrading to next-generation
PET/CT systems, while at the same time incorporated Myocardial Blood Flow Reserve results to
further increase the diagnostic benefit patients receive. This helped to give the physicians an even
greater sight into the patients’ diagnosis and treatment by adding to the data obtained for the
patient during their Myocardial Perfusion Stress Test.

Modern Nuclear, Inc. has consistently worked in close collaboration with experienced legal counsel
to ensure compliance with applicable federal healthcare laws, including the Stark Law and the Anti-
Kickback Statute. Following the passing of the company’s founder, Pat Laverty, Sr., the federal
government initiated an investigation focused on regulatory compliance, including areas such as
physician supervision requirements and compensation arrangements.

Following the resolution, Modern Nuclear, Inc. will continue to work with the DOJ through the Office
of Inspector General (OIG) to further enhance its compliance infrastructure to provide physicians
and partners with the highest level of confidence in the company’s operations and regulatory
adherence.

Physicians considering the expansion of their practices through Designated Health Services (DHS)
offered by third-party providers are encouraged to ensure that all arrangements remain fully
compliant with Stark Law, Anti-Kickback Statute requirements including Fair Market Value (FMV)
compensation, and any regulations relevant to that particular DHS.

Working hand-in-hand with the OIG has given Modern Nuclear, Inc. and its customers an even
greater level of confidence and security. As a result, patients will continue to benefit from more
accurate diagnostic testing, fewer false positives & negatives, reduced unnecessary follow-up
procedures, and lower radiation exposure.
